A friend was recently fined for having an unrestrained rear passenger in an early holden that was not originaly fitted with rear seat belts. He mentioned this to the officer but the fine was still given. Have the laws changed?

My ‘57 Chevy never had any belts. Still doesn’t and it’s regoed in NSW.

In NSW cars built before Jan 1965 require no seatbelts at all, & between Jan 65 & when the relevant ADR came in (around 1971) front belts only are required.

Having said that I believe that ANY passenger aged 16 or under must have a seat belt, so that means only those 17 & above are allowed to be passengers in these older cars, if there is no belt fitted.

Dr Terry is on the money. Just to add that for the over 16s to be able to legally sit in the non seatbelt spot, all of the actual seat belts have to be taken (no-one can sit in the backseat without a belt if a belted front spot is available).
