hi i sold a seconhand hyundai accent to a guy for $2100 no redgo, he drives it home and on they way the clutch craps it self, he rings up and wants to bring it back for a refund, he did not test drive the car or bring a mechanic to check it out, i drove the car around my local streets i never had a problem with it, i only had the car a few months was originaly going to fix the car for my self plans changed, he knocked me down $400 on the price and the receit said as is where is, i offered no refund but to supply a new clutch or he can supply the clutch and i,ll fit, do i morially owe him a redfund??
really i think it,s buyer beware, im not a dealer of any sort

Tell him to go jump.
He bought it - the minute it's paid for, it becomes his problem.
What if the rego plate was called out on the radio as the winning plate for a $5000 prize - I'm sure he'd have a different view of who is responsible for the car....
Anyway, what does he expect out of a $2K hyundai?
(and why did he drive an unreg'd car home?)
If he wanted a warranty, he should have bought a car from a dealer.

What Mick said is absolutely correct.
BUT, this fella knows where you live, knows your phone number, and if he is willing to drive a car home unregistered, then not the most morally correct individual, adding to the fact that he called you up and complained, knowing full well that he bought the car "as is where is".
What is the chance of him coming back sometime and doing everything from throwing rocks on your house in the middle of the night to watching when you and your family go out one day and cleaning the house out??
The chances of this happening are slim at best, but there are plenty out there that think they have been dealt a crappy hand in life and will want to take from those that they feel have screwed them over.
You would know what type of guy he is? make a decision based on that, but sometimes it is better to give him his cash back and change the clutch, and then try and resell the sucker yourself.
This is just my experience, I sold a crashed Car for parts once, it was hit up the back and the front, still drove fine, but the insurance company wrote it off. Sold it for $400, explained all that had happened to the car. Some young kid bought it and drove it home. A week later I get a call from his uncle who made it well known he was a member of a well known motorcycle club, ranted and raved how it was illegal to sell a car that was defected and rar rar rar, do you know who I am, do you know what I can do type stuff. For $400 was it worth the effort? I told him to keep the car and come back and get his cash. After they got the cash I never heard from them again.
I am not saying do that in this case, but weigh up the possible outcomes for you and your family and make a decision based on that.

Tell him to pay the other $400 then buy a clutch and give it to him.

had the same thing happen to me sold the ute for $12000 years back the guy rings back a day later saying the lights went out on the way back from a party that night and hit a tree blaming the electrical system and he wanted his money back saying he knows were i live i'm going to kill you ra ra ra.i told him maybe your lights went out (too much to drink) and i also know were you live.but i was single back then with no kids.things are a bit different back then.sounds like this fella gave the car a good thrashing on the way home maybe let him know this and offer his money back if he replaces the clutch.

He bought an unregistered car and then drove it home. You sold it on an "as is where is" basis, he agreed to that by signing or accepting the receipt. Did you see his drivers lic?
Once the car is off your premises it is his, no if's but's or maybe's.
Go down to the local cop shop and have a word with the sergeant on duty, ask them if they know him or if he's in the system. Also if the car has plates on it you might be liable for any fines he might've racked up. Point to remember... if selling an unreg car, hand the plates in first.
Up to you really, if you think he is a threat have him bring the car back and give him his money back, if not deduct the price of the clutch and give that much back or tell him stiff sh1t.

you have no legal duty to refund him, buyer beware, you wrote `as is` and he took it,bad luck to him. If you are concerned contact the police and tell him that they are aware of your situation.

he bought his own number plates and screwed them on the car, i said not a good idea but your choice, he was a young nancy boy about 20 with the pretty clothes, he has never been threataning at any stage.
i was waiting for a call from his parents, but i think i know what they will say (your problem son)
i gave him all the opertunity to drive the car or have it inspected by who ever he wanted, as far as im concerned he is not getting a refund, i will buy him a clutch and he can fit it or get his mechanic to fit it as he has no idea or he can buy the clutch and i,ll fit it.
i think this is more than fare???? pete.

i cant help but feel he wanted a new car for $2000 i have bought many cheap cars over the years and if they F****D up on the way home i just fixed em.

he knows where you live, and you probably don't know where he lives.
and you probably don't know what he is capable of either.
if driving an unregisted Hyundai around is his cup of tea, don't be surprised what other dodgy stuff he can do!!!

i had this happen as well had a 1 tonner with worked motor etc went like the clappers decided to sell as i wanted a sedan to play with i eventually sold it to a young guy who was a p plater i even made his parents come a check it out every thing was above board they liked it checked it couldnt fault it anyway 2 days later get a call from said buyer wants a refund as the motor has died as he lived near by i could hear him thrashing the crap out of it told him as much and gave him the number of good mechanic and told him to be on his way

Ccheck the front tyres for scratches around the tread indicating that burnouts have been done.

yep iv'e been there, i always done the same, just fixed them it's the risk you take when buying cheap old(ish) cars i think your being fair, if it was me i'd buy the clutch and get you to fit it

I cn agree with both sides of the coin as stated previous. Couls be worth the effort to do as you said and buy him a clutch. They are quite cheap.
