lol. back on topic Greg. RS appears to be acting a little evasively here, and although it is stated on the Sandman forum by others that RS has complete exclusivity on all trademarked lines, RS has not confirmed or denied this. It may be in RS' interests to make this the perception, but it would be highly unusual for GM Corporate to assign exclusivity as they certainly don't do that in the States.
Of course if everyone just "believes" that they have exclusivity then it makes it much easier for RS to cut themselves in on any production items if the independent manufacturer 'believes' that they should contact RS rather than GM.
Be interesting to see if we get a straight answer out of RS on one simple question:
"Do you have exclusive licensing on reproduction of all lines that would contain GMH trade mark?"

The silence on this one is deafening. I think we can conclude that as much as RS would like everyone to think they have exclusive licensing,

Yeah, the use of "Holden Restoration Parts by Rare Spares" is exclusive, but you don't have exclusive licensing on GMH trademark (but you are happy for others to think you do)

Would hardly be a breach of confidentiality to declare the extent of your licensing Les. Obviously is in your interest for all the plebs to run anything by you rather than GM Legal which ain't easy to do. From my perspective this looks fairly sly...

With all due respect Leslie, I think your customers deserve a little more than the evasive runaround answers you are handing out. Everything's rosy when you make your big announcement re HRP or need parts to copy but when the questions get a little too hard you all head for the bunkers. C'mon mate - what's the story? You have sat quietly by on several forums where people were saying "RS Exclusive" and never piped up to confirm or deny. What's the go? Why don't you spit it out? Let's all make it really clear hey? It looks like all you've got exclusive is what you have already made applications for, everything else is open market. Is that closer to the truth? And is it closer to the truth that you hid behind GMH licensing while you quietly shut Jason StickThis down? C'mon Les, spill the beans.
Your non-answers have (demonstrably) led to the public perception that nobody can get GM licensing on GMH Trademark without going through you and Rare Spares first. My advice is that if this is not the case you would be better off admitting it now before you end up in front of the ACCC for creating a false belief with regards to competition.

Bob Thank you for pointing out a major error in our web site as you know Rare Spares always welcomes feedback and yes this error was very unprofessional, I was so concerned that I could hardly sleep last night. I have this morning asked our IT department to correct the major error in our page which should now be done; BTW the employee that caused the error is now no longer at Rare Spares. Bob you are obviously a busy person and have many things in life you could enjoy so thanks again for taking the time from your busy schedule to point out this major error. Les

Now whats the go with your licensing? I don't want to see you get in hot water with the ACCC for creating a false belief...

I agree with Bob. What is the problem with answering the questions? They are very basic and wouldn't impede your business, unless of course you want to create the false impression that only Rare Spares can use GMH logo etc, and thus reduce competition and therefore increase your profits. Sounds anti-competitive to me. |

FOI only applies to govt, not private companies. Pretty rude of them not to answer anyway considering how long they've had their hand out to the public seeking help on parts, part numbers, samples, etc.
